A few years ago I took out some payday loans, one with Advance America, and with another firm who eventually was merged into Advance America. I simply ran out of money to pay them and they were far from willing to negotiate a payoff plan or a settlement. This was when I lived in Ca.
I have since moved to Nevada to get a lower cost of living but still barely make it as I do online surveys to supplement my Railroad Retirement (RR worker equivalent of Soc Sec).
I just do not have the money to pay them now as caught in the situation where I just make too much for any gov’t help. A company called Sullivan Law (Md) is using the explanation calling it check fraud (even though this conflicts with the Ca Deferred Deposit Transaction Law) as a way to get around the law.
I get these calls a few times a month and when we do connect their only response is that it is a small amount, just pay, pay, pay.
FWIW they have yet to send me any evidence of the alleged debt. They may or may not know that I have moved to NV. While I doubt they will take me to court as any judge will see I simply cannot pay (I have struggled just to improve my FICO from 527 to 570) and have used every which way I can think of to financially stay above water.
I recently even cut the cord. I had a Ch 7 4.5 years ago as I have been one of those who has never really done well with expenses vs income.
I got burned badly by GWB and his cronies and thus an inheritance in 2007 went to hell. I think I manage things quite well but with unethical law firms like this, I need to silence their inappropriate actions. What do u suggest?
What can be done to stop this law firm from calling the inability to pay off payday loans check fraud and get them off my back?
You may want to the who can run interference for you for a very low cost. Or you can an attorney who is licensed in your state.
The reason this is important is if the law firm attempting to collect is tossing law at you, you need a legal representative to find out if that is a smoke screen or not.
You indicated the debt collection company ing you is called Sullivan Law and indicated they are out of Maryland. While there is a company registered to do business in Nevada named Sullivan Law it is not clear if it is the same entity. If not, then the collector ing you may not be authorized to do business in Nevada.
